Terms of Service

These Terms of Service govern the use of the TOS FANY Content Distribution Engine (“TOS FANY CDE”), operated by TOS FANY.

By accessing, authorizing or using TOS FANY CDE, you agree to these Terms.

Purpose of TOS FANY CDE

TOS FANY CDE is a content-management, automation and distribution system designed to help authorized users organize, schedule, process and publish digital content to supported platforms.

Functions may include content scheduling, audience and content categorization, media retrieval, publishing automation, publishing-status tracking, performance monitoring and related content-distribution activities.

Account Authorization

Users may connect third-party accounts, including Google services and YouTube, through approved authentication mechanisms such as OAuth.

You must only connect accounts that you own or are legally authorized to manage.

TOS FANY CDE will only perform actions permitted by the access granted to it.

You remain responsible for maintaining appropriate permissions for connected accounts.

User Content

You retain ownership of content that you submit to TOS FANY CDE.

By using the service, you authorize TOS FANY CDE to access, process, store temporarily where necessary, and transmit your content solely for the purpose of providing the requested service.

You are responsible for ensuring that you have all necessary copyright, trademark, privacy, publicity and other rights required to distribute the content.

Platform Rules

Publishing through TOS FANY CDE remains subject to the terms, policies and technical requirements of third-party platforms including Google and YouTube.

TOS FANY does not control the availability, algorithms, approval processes, API limits, policy decisions, account restrictions or service changes imposed by third-party platforms.

A successful transmission from TOS FANY CDE does not guarantee that a platform will make content publicly available or distribute it to a particular audience.

Acceptable Use

TOS FANY CDE must not be used to distribute unlawful content, infringe intellectual-property rights, gain unauthorized access to third-party accounts, impersonate others, manipulate platforms unlawfully, spread malicious software, or violate the terms of connected platforms.

TOS FANY may restrict or terminate access where the system is being used unlawfully or in a manner that threatens the security or integrity of the service.

Service Availability

We aim to keep TOS FANY CDE operational and reliable but do not guarantee uninterrupted or error-free availability.

The service may occasionally be affected by maintenance, internet connectivity, hosting providers, API changes, third-party outages, quota restrictions or platform policy changes.

Features may be modified, added or discontinued as the system develops.

Third-Party Services

TOS FANY CDE integrates with third-party services.

Your use of those services remains subject to their respective terms and privacy policies.

TOS FANY is not responsible for changes made by third-party providers to their APIs, authentication systems, platform rules, availability or pricing.

Privacy

Use of personal information and Google user data through TOS FANY CDE is governed by the TOS FANY Privacy Policy.

Intellectual Property

The TOS FANY name, brand, software configuration, workflows, systems, documentation and associated intellectual property remain the property of TOS FANY or their respective licensors.

These Terms do not transfer ownership of TOS FANY intellectual property to users.

Disclaimer

TOS FANY CDE is provided on an “as available” basis.

While reasonable efforts are made to maintain reliable operation, TOS FANY does not guarantee specific audience reach, views, engagement, sales, leads, revenue or other commercial outcomes resulting from content distribution.

Limitation of Liability

To the maximum extent permitted by applicable law, TOS FANY will not be liable for indirect, incidental, special or consequential losses resulting from use of TOS FANY CDE, third-party platform decisions, account restrictions, service interruptions or unauthorized use of user accounts outside TOS FANY's reasonable control.

Termination

Users may stop using TOS FANY CDE and revoke connected account permissions at any time.

TOS FANY may suspend or terminate access where necessary to protect the system, comply with legal requirements or address misuse of the service.

Governing Law

These Terms are governed by the applicable laws of the Federal Republic of Nigeria.

Changes to These Terms

TOS FANY may update these Terms as the service evolves.

The current version will be published on the TOS FANY website together with its effective date.
